Transcripts of the Trial

Dwin is seen the next day asking around for any guano samples that may have been taken into evidence at the scene.

@48d00cad86:
If Uthger win, then Tempus was right ask Uthger to kill, and justice also be served.
Theaon sitting in the commons, lets out a smirk and head back to the Legion Halls muttering something
"If people did the research and found out Tempus doesn't speak directly to his followers and instead uses the spirits of fallen warriors I'd see what their expressions were."
-
((Another grueling session. I don't know if, outside of Peltarch politics, so many characters have been so worked over in such a confined space without spawning a single monster. Rest assured, the Council will be exploring alternatives for dealing with big city problems now that the peaceful village is overrun with Norwick and Romani camp refugees.
I'd like to say thanks to Gobbletom, Cera, and Maythor for their help with setting up the event and driving so many of the NPCs. Also many thanks to Grag, Ger, and all of the key witnesses and councilmembers for helping to keep the tension high. Also, special thanks to Merin for taking plenty of notes.
There will be a seperate thread for the Council's discussions. I will leave it open for all to see, but I ask that only Council members (or their duly appointed representatives) post in the thread as it will be IC "secret" even though it will be open to all OOC.))
Lens and the other council members begin discussions, poring over the transcripts, and putting together key points. When asked by the rest of the council, Scutum gladly offers to deliver a request to Maya.
-
Maya sits quietly in the back of the room. She is dressed in a decorated deer skin shift, her hair unbraided and hanging in loose uneven sheaves down her back. She is perhaps unnoticed, looking like any other peasant woman in the village.
She regards the trial with mixed emotions and incomprehension. She listens carefully enough, but some of the words have little meaning to her, and the trial is a game of truth and misdirection that lies outside her understanding. As the trial wears on her attentions eventually wander, and she simply looks at all with great sorrow.
When it is over, she gets up and sits on one of the benches in the Jiyyd commons. One of the villagers comes over and sits beside her. They speak for a while, and those that wander by catch pieces of the conversation.
“…and I do not understand this. We have two of Narfell greatest warriors. One is Grag who believe in Tyr, god of Justice. Other is Uthger, who worship Tempus, lord of battle. Why not have duel between them and settle quick and with honor? If Grag win, then justice be served and Uthger die in name of Tempus, and all will be good. If Uthger win, then Tempus was right ask Uthger to kill, and justice also be served. Grag will die with honor in name of justice, and all will be good.”
She pauses and looks up into the sky, a look of great sadness in her eyes. “Here…”, she continues, “…there will be no honor. Tempus will not be happy to have great warrior like Uthger die in execute or jail, and justice will not be serve, for think Grag know is some fault there too. Is so wrong, and is so sad.”

A second set of books makes it way around…apparently they contain the next part of the trial, the final transcript
@9ea16b7e48=Merin:
Lens:Uthger, do you concede the point that you did in fact kill Cyrus? I do not recall which killings you claimed responsibility for.
Utgher: I concede killing him…just not in the temple
After 6 years...the general should have his facts prepared
Lens: Is the location of the killing under dispute?
Grag: I do not recall saying that...
I recall saying undead were seen in the temple...
and that he killed cyrus... I may have jumbled my words, though I admit, but thats not the point...lets hear from the course, eh?
the point is he killed a citizen from Jiyyd and admits it... 3 times over!
Lens; Very well, Call your witness, General. We need not hear testimony about the killings unless it is pertinent to other aspects of the case, since he has conceded that he did in fact kill cyrus
Grag: Do you wish to know if he was armed or not?
Mariston...you have heard what the council would like, can you please stand and add what you may to this?
Mariston: The attack took place in the lair of the demon wolf creature
We had gone there to rid the lands of an evil. Those whom went were Sir Cyrus, Lady Anna, Zurk, and mineself.
We fought the creature and defeated it, however our companion Zurk had fallen, and I had been sorely wounded. Sir Cyrus kindly healed me and took Zurks body to carry back to Jiyyd.
The Lady Anna and I did retrieve our companins pack, at this point we had noticed our exit had been barred.
Then many of the featherlight Tribe entered and attacked us, we sought to speak with them. At this point one of the Featherlight men spoke
"For honour you won't have me! For the blood of my tribe! If I have to die so be it!" the man attacked Sir Cyrus wom used his shield to block the blows, at this point Uthger arrived saying "stop"
Sir Cyrus explained that he was attacked and merely defending. The Featherlight then exclaimed "Assassin rat!" Lady Anna called for the featherlight to half his attack. To which Uthger glared and said "Kill him and you drop"
The Featherlight then fell, semmingly exhausted by his attack.
Uthger then spoke "Why are my people dead in here?"
Sir Cyrus answered "They entered and attacked, while we asked why" Lady Anna spoke with some irritation "Well it would seem they have penchant for attacking while we recovered the body of our dead friend".
Uthger then contuned to ask what had occured ignoring what had been said.
Uthger spoke "And when I asked you to stop?"
Sir Cyrus said "I stopped, but he did not" At this point Uthger then attacked Sir Cyrus without warning in a cowardly way, he knocked him to the ground as he held the body of our fallen friend. He then proceeded to murder him.
Grag: While he was holding a dead mans body?
Mariston: Lady Anna and I called for him to stop his attack.
Aye
I called for him to stop. Lady Anna more directly called "Uthger stop this you crazed lunatic!"
Grag: Do you swear on your god to this sight ye saw?
Mariston: I do.
Grag: And whom do you serve?
Mariston: I serve Torm.
Grag: Let the record show Mariston folower of Torm swears by his God to this.
Lens: Vroka?
Grag: Was there anything else odd you saw besides a cowardly attack?
Uthger: Objections...Cowardly...Grag was not there.
Mariston: Only that Uthger took one of the bodies with him as he left, at which point he threatened Lady Anna and mineself.
Grag: Mariston, is the oone who said...cowardly way.. I am repeating his statement.
Vroka: Is what you say truth, swear by your god?
Mariston: This is the truth my lady, In Torms Name.
Grag: Council...any questions for Mariston?
Just'ene: What expertise do you possess that would give you the insight as to if the attack was cowardly or not?
Mariston: To attack a foe who is ill prepared for ones attack as they carry the dead is without honour in Tempus's eyes.
Just'ene: Do you follow Tempus?
Yes or no?
Mariston: Nay.
Justene: Then you wouldn't know for sure, correct? Yes or no.
Mariston: I hath studied comparative theology at temple, however I shall conceed I may be mistaken.
Justene: Keep your opinions to yourselves. We only want the facts. That goes for all witnesses and both parties.
Mariston: Mine apologies.
Scutum: Hiya!
Mariston: Greetings
Scutum: Did ye ever find out why them plainsfolk attacked ye?
Mariston: We never did find an answer to that question.
Scutum: Hmm, so they mighta had good reason for it?
Mariston: maychance, though I wish to speculate again.
Scutum: I understand. Thanks!
Lens; Anybody else?
Very well, hearing nothing further, would you like to cross-examine the witness, or any of Grag's witnesses at this point, UTgher?
Uthger: I would
Why did you never find out why the Featherlights attacked?
Mariston: We sought sanctuary in the city, as we thught further attacks wouldst be expected.
Uthger: Let me rephrase. Why were you not able to ask the man that was alive when I arrived why he was attacked.
Mariston: We did ask.
Uthger; Forget it...I'll move on.
You heard me warn Cyrus not to kill the second warrior, yes?
Mariston: Indeed I heard thou warn sir Cyrus this.
Uthger; Yet...Cyrus slayed him anways.
Mariston; The man was continuing his attack upon Sir Cyrus. Failing to stop. Sir Cyrus backed away blocking with his shield.
The man fell at this point.
Sir Cyrus was asking the fellow to stop his attack.Uthger; Would be nice if you would just answer my questions as I ask them...forget this...worse than the city...never mind.
Lens: Hmmph
Grag: Temper Temper there, Uth
Justene: Let me try to interject here.
Cyrus killed the man, yes or no?
Uthger; I am not feeling well, and after several hours of testimony you have only established what I already admitted to.
Mariston: The man fell before sir Cyrus
Justene; One last time, did Cyrus kill the man, yes or no?
Mariston: Yes
Justene: Was it in self defense to your knowledge? Yes or no?
Mariston: Yes.
Justene; This was after Mister Uthger came in? Yes or no?
Mariston: Yes.
Justene; This was after Mister Uthger ordered that the fighting cease? Yes or no?
Mariston: No.
The man was never asked to stop
Justene; Thats all from me for now.
Uthger: May I make a point?
Lens; Cyrus was never asked to stop fighting?
Sir Mariston?
Mariston: Uthger entered and spoke "Stop" at which point the Featherlight spoke "Assassin Rat" and continued to attack Sir Cyrus
Lens: Ok, your point, Uthger?
Uthger; My point is...if these men...were such a threat...why were they so easily killed by an unarmed cleric...and why did the cleric have his weapon away unless he thought the man harmless?
Lens; Was that a question to the witness, Uthger, or a comment to the Council?
Uthger: Just a comment to consider...since the only ne who could answer is Cyrus...and he's gone.
Lens; Very well. Are you through with this witness?
Justene: One more question for Sir Mariston
Lens; Oh
Grag: Cyrus is dead..
Justene: When I asked you earlier if this was after Mister Uthger ordered that the fighting cease, did you not understand the question?
Because you have clearly contradicted yourself.
Mariston: I did, however I was not sure to whom them word stop was directed and would not with to colour this with opinion.
Justene; But by saying that the man was never ordered to stop as you did, you did colour it with opinion.
Becasue you assumed it was meant for Cyrus and not for the man
Mariston: I spoke that the word stop was said.
Grag: That all for our witness?
Vroka: He thinks he tells the truth
Grag: I have a few things to add in closing, then I rest my case Council
Lens: Uthger has the right to question your witnesses first, General, before calling his own
Whom you may wish to question, before resting.
Are you through with this witness, Uthger?
Uthger; No
Lens; Carry on then
Uthger; Did I attack anyone there besides Cyrus?
Mariston: Nay, though didst not.
Uthger; That is all
Lens: Very well, you may return to your seat Sir Mariston. The council thanks you for your testimony.
Mariston: Thank thee.
Lens; Do you wish to question any of General Grag's other witnesses, Uthger?
uthger; Only the General himself
Grag: Sure
Lens; One moment. Vroka?
Vroka; Okay.
Lens; Go ahead.
Uthger: General, I would just like to clear up some things you said earlier.
You made many claims as fact.
Are you skilled in magic?
Grag: nay.
Uthger; Are you skilled in summoning undead?
Grag: Nay, but you think I did not have this researched?
Uthger; I am asking you
Please answer.
GragL Just did...nay myself.
Uthger; So how can you be sure it was I who summoned the undead you testified to?
Grag: Because theaon, is a cleric and he says you did it, and Kaell is proficient in magicks and necromancies as well, thats how I am sure.
Uthger; Kaell is not here, as you said, he is scared, please do not speak for him
Grag: And they both were there.
I did answer, does the council object to my answer?
Uthger; If Theaon is so versed in the undead, why did you yourself research it as you just stated...do you not trust his knowledge?
Grag: I just told you...the spellweaver's keep researched it...at the time headed up by Kaell. I consulted many as I said I am nay an expert in this field.
Uthger; So, you had two people you trusted witness this...Kaell profiecient with magicks and necromancy...and yet yu had them research it anyways...is this your statement?
Grag: Yes. Like any good researcher...I wanted to make sure...an not rely on words or someones thought or whim, or something they heard like a god telling them to murder people?
Uthger; So it took you six years to be sure?
Grag: nay, you have not been around for six years, ye just started popping your head back up here.
Olem: And it feels like its takign another six years for this trial
Grag: That is? Cause, I have a good question for you.
Uthger; Since you have done your research...are vampires undead? I am not sure?
Lens; General, wait untily uor turn to ask questions again, please
Grag: What is the relevance of that?
Uthger; There was a vampire in the room when we fought..I am just curious if its possible it summoned this skeleton
Grag: The vampire was dead with its head cut off...I doubt it was sommoning anything.
Uthger; Ok I am ready to tell my side of the events now
Grag: Do you wish to hear my closing now or after?
Lens: Not yet, General
Utgher: May I begin?
Lens; Are you done questioning Grag's witnesses?
Uthger: Yes
Lens; very Well. Berrete?
Berrete; Oh, oh, I just wanted to ask something, or figure it out.
Something like that. You yourself don't know if he summoned a dead thing in the room, right?
Grag: Right...
Berrete: Oh
Lens; Any other questions for Grag's witnesses before Uthger moves on?
Vroka: I would ask Little Theaon a question
Yes?
Theaon: Ask away Ma'am.
Lens; If you are ready, Master Theaon?
Theaon: Aye Councilman
Vroka; Chop the head off the vampire?
Theaon: Yes
Vroka; No need to do anything else? Holy Water? Garlic?
Theaon; That is all effective on him, however decaptitating them will ensure death even without holy water, garlic, or silver.
vroka; You think you are telling the truth, but I do not think so.
Theaon; Well, I've seen it happen before with all respect ma'am.
Lens; That was...productive.
Theaon: Will that be all?
Lens; You may sit, Master Theaon
Go ahead Justene
Justene: I beleive you must stuff the mouth full of holy wafers after the head is severed. But I can't be for certain
Lens; Was that all?
Councilman Dolvak?
Dwin: aye.
Theaon: We know she was dead ma'am.
Sorry, wasn't my turn, I'll wait.
DWin: First, was the head completely seperated from the body?
Justene: She's a vampire, of course she was dead.
Lens; Are you asking Theaon that question, Councilman?
Dwin: No, the General
Grag: Was a good clean chop...dwin...made by the union's own axe makers.
So, aye.
Dwin: i have severed many a head, but they don't always come clean. Did it roll away, or was it still near the body?
Grag: Not to mention at the time, I am no expert, but the axe was silver
Dwin: Well?
Grag: I do not know where head was, as this is the moment I was struck from behind.
Dwin: So, we don't know that the decapitation was complete.
Was a thorough search of the house made for the vampires Mate?
Grag: I saw it sever...I do nay know if I kicked it across the room, or if it was next to body
Vampire's mate?
Dwin: aye, they usually travel in groups of two or more...I assume there was another.
Grag: no, the vampire came alone
Dwin: And you know this how?
Grag: To my knowledge it was alone as well as the invisibility spell Kaell had on himself at the time to make sure none others were present to his sight. With his spell.
Dwin: Did you cast this spell?
Grag: No, I am not a magick man
Dwin: So you assume this vampire was alone...but you do not know for sure.
Grag: According to those that could see invisibility, aye, I assume this, unless Kaell was lying
Dwin: Did you check the house and its attick for bats?
Please Asnwer
Grag:I saw no bats fluttering about
We don't have an attic, so no, I did not look in the attic.
We got the vaulted ceilings.
Dwin: So, you did not search the premises for bats. No further questions.
Grag: Can we hear Uthger's story now?
Justene: What is the purpose of all this vampire talk anyway? He admitted to the murders?
Lens; Right...that IS all, isn't it?
Grag: I don't know. The council is asking the questions.
Lens; Apologies General. Uthger, please proceed. Oh wait...
Vroka?
Vroka: Ready
Lens; Go ahead, Uthger
Uthger; If this were the city to the North, I would spend the next days pointing out the many contradictions in the testimony of the General and his men...
But I won't dishonour the purpose of this council with that. This trial has taken up too much time as it is.
The General lumps everything into one event, but there are really two.
The incident with Cyrus was seperate from anything that happened in the Legion Hall that day
Cyrus had been reported in the Featherlights lands before, stealing from their chests, killing them, in the name of good.
When I entered the temple at the summoning of my Totem, I told them all to stop that I may find out what was going on.
I saw Cyrus slay my kin after my warning...the man was so weak, he fell from a simple fist...I followed the traditions and ways of my people and killed him...one of the party for two of my kin...and left to dispose of the body.
So yes, I killed Cyrus.
It is said that Cyrus was unarmed...but I do not need to remind the council of the skill Kanen has with a shield...able to knock many creatures to their knee's, or the skills of scutum...with her bare hands
The incident in the legion hall is different
Grag says we were good friends before this...this it not true...or better yet, not accurate
His army had spent the better part of 10 years threatening my life.
Grag: Objection
Uthger: I was even attacked by one of them, and spared the life to keep the peace.
Lens; What is the objection?
Grag: One man in an army of fifty of is hardly my whole army...and this man was sentanced to a month in jail for his actions...Dwarron, I believe.
Dwin: Was he under your comand?
Grag: When he is on duty, aye...as I said, he was sentanced to jail time for his actions.
But again, one, is hardly an army
Done.
Lens; Were there others, Uthger?
Uthger: Yes
Lens; Who?
Uthger: Rando, while he was a member, Maythor...Elord
Grag: Your problems with Norwick are seperate
Uthger: We can debate this for hours...I only wish to emphasize there was a past hostility between myself and the legion
Grag: Maybe I can help this out...did I show you hostility
Uthger; You said you would back your men...so yes.
Lens; Were Rando and Elord Members of the Legion at the time you had issues with them Uthger?
Uthger; Yes
Lens: Fine, please continue.
Uthger; Thank you...now, there was some hostility between myself and the legion for that...there was also the legions protection of a criminal I was sworn to apprehend.
When i served the city to the North, Myeil used mind magics to attack an officer there...I had given my word to apprehend her, but she was protected by Grag and Kaell
Talgrath: Hold on a moment, that ain't it.
Dwin: Silence!
Uthger; I was told to bring Grag and Kaell in by force
Lens; Quiet in the gallerly please.
Talgrath: if I may, thats incorrect
Dwin: you may not
Lens; You may not, sit down please
Grag: I shall cross-examine Tal....
Talgrath: Fine
Uthger; As I said, I had given my word, and I keep my word bound by Tempus
Now...the Legion has also had some interesting members in its group over the years.
Sasha, and if I'm nt mistaken...Wolde
Grag: Objections, Irrelevant.
Lens; Excuse me General?
Grag; He is on trial for a crime against Jiyyd, not to tell the council who is a member of the Legion
Lens: If you are making a point Uthger, I suggest you get to it. In the meantime...
Grag: Council, the General stated several times that I was foolish to follow the will of my God on a "whim", I wish to show that in fact the choice was easy based on the past of the Legion's actions
Lens: I see. Carry on, but make sure you stick to that point then.
Uthger; I will if allowed to get there.
Sasha was a drow, who the legion welcomed into tis ranks. She also helped Yurana, the fallen vampire, lead the drow attacks on Norwick, killing many citizens.
Grag: Objection. We had nay clue she was a drow...she looked just like Braeth.
Uthger: You can tell how to kill a vampire, trust in the magic of your friends, and don't investigate a drow?
As I was saying, the General contends that I was foolish to have faith in my God.
That I shouldn't have followed him on a 'whim'
But, given the past behaviors...I still intended that day to help him, until I was instructed otherwise.
And when Tempus told me to slay him...and then the others when they attacked me...I saw no reason not to trust in my faith.
But I understand the Generals concern. I fear this trial maybe a result of treachery, but not from me.
The general asked me to help him slay the vampire because she had stolen his love Cotton.
I belive it quite possible that Cotton and the Vampire set this up...know how myself and my god would react...so that the Vampire Yurana would be killed.
Lens; Wait, Wait, Wait...What?
Uthger; Forgive me, I am tired.
Didn't you ask me for help slaying the vampire...because she took Cotton from you?
Grag: I asked ye for help because it was an evil vampire that used mind powers on people, so I needed all the help I could get. Besides, ye already questioned me can we move on?
Uthger: Is that a yes, or a no?
Grag: I just answered it, quit trying to play one of your words Uth...
Ye already questioned me, now you are requestioning me.
Uthger; I understand that you don't want to talk about it...after you killed the vampire she returned..."saved" and rann off with Cotton
Lens; Is there anybody in this chamber who knows what he is talking about?
Ginger; I do.
Lens; Miss Ginger?
Uthger; Forgive me, I only know a little of the ways of such things...and I am quite fatigued.
Lens: Miss Khaya...
Miss Tindra. Can one of you speak on the bhalf of the three of you?
Tindra; I know cotton was with a woman while living in the gypsy camp shortly before this event that is discussessed...can't say I know who, I didn't pry.
Ginger: I think Miss Khaya can tell the events as well as anyone. She was in the Temple of Helm as well, and knows the Events.
Lens; Yes General?
Grag: Lens, I don't know where we are going with this. But if you get into the whole love story of cotton, you will be here for a good decade
Lens; Miss Khaya? Can you make your statement quickly?
Khaya; Cotten and Arwen were lovers. Arwen was the Vampire, previously known as Yurana, when she was still na elf.
Khaya; Following Arwen's Death, I was asked by a distraught Cotten to reasearch raising her from the dead.
Lyte; So she was indeed dead? For sure?
Lens: ORDER! ORDER!
Miss Lyte, are you acting as councilwoman on Grag's behalf?
Lyte: I am. At least, that is what you all had said.
Lens; Then please come up here before you ask your questions.
Lyte; I was waiting to be asked sir.
Lens; Go on then, Miss Lyte.
Lyte; We were all very interested earlier...about whether or not...the axe blow had actually killed the vampire, keeping it from summoning anything.
Khaya: The vampire was dead by the time she was raised.
Lyte: Miss Khaya is in a position just now, to testify it was.
Khaya; Whether or not she was dead prior to that time? I cannot say.
Lyte; But she was very dead when you saw her?
Lens; So, at the time she was raised, she was dead. Excellent.
Khaya; Yes, or else the channeling would not have worked.
There were several days between the battle and the raising.
Uthger: Can I continue?
Lens; You are saying that the person known as Yurana, or Arwen, was a vampire, and that she was killed and then raised, and was the lover of the former Mrs. Grag?
Khaya: Yes, Raised, to Clarify, as a fully living being, no longer undead.
Grag: Aye, we was divorced at this time, she was sleeping with all kinds of women, so I left her, if that helps, or would you like a list of all the women she was with too?
Lens; That won't be necessary, General. Uthger, please continue, and explain what that had to do with these charges?
Uthger; I have explained my reasons for doing what I did, I just wished that point brought up to show that its possible others were behind this whole thing..I grow tired, and just with this over with.
Lens; Do you have anything further then, Uthger?
Uthger: And request the council keep my past service to the town...including fighting the orcs when they took over this town, and dying to save scutum from a vampire, before you rule.
Scutum: I hate vampires.
Uthger: Me too.
Lens: General, do you wish to cross-examine Uthger?
Grag: I have statements. We are all tired, I will take a few minutes and wrap this up.
Facts: He murdered me, Theaon, and attempted on Kaell.
He attacked me in the back...fact.
Uthger: Objection, if you were dead, how do you know what I did to Kaell, he is not here speaking.
Grag: I have witnesses that said you tried to kill him...
Lens; I did not hear any witnesses to that charge
Grag: I will not bring any more witnesses
Tempus Clergy states; They frown upon attacking from the back. Why would he disobey Tempus attacking me in this way? Council?
Lastly...to make this short. Even if Tempus told him to kill me...what does that have to do...with our laws/ He still broke Jiyyd's laws, and murdered a Councilman and Theaon. That is a Fact. Simple!
If he murdered you Lens, we would be after his head, with no trial, that we know. I am done.
May Tyr guide your decisions.
Lens: Any closing statements, Uthger?
Uthger; No, I've said all I care to, just hurry before I die.
Lens; Very Well, the Council Stands adjourned to discuss the verdict.
Grag: I suggest we don't give Uthger his axe till after the verdict?
Lens: Thank you all for your participation
Uthger: If you do that, I will be dead before the verdict.
I am bonded to it. and it to me, neither of us can exist for much longer if we remain apart...I came willingly to the trial...and have shown now aggression
Lens: We will not let him die while awaiting a verdict.
The Council will announce a verdict when our discussions are complete.
Grag: I must get back to duty. Are we done?
